These Terms of Service (“Terms”) govern your use of the websites, applications, and services provided by AccessLint, LLC (“AccessLint”, “we”, “us”), including automated accessibility testing for repositories and websites (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.
Accounts
You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information when creating an account and keep it up to date. You must notify us promptly of any unauthorized use of your account.
Acceptable use
You agree to use the Service only for lawful purposes. You may not:
- Scan, test, or monitor websites or repositories you do not own or lack authorization to test.
- Interfere with or disrupt the integrity or performance of the Service.
- Attempt to gain unauthorized access to the Service or its related systems.
- Resell or redistribute the Service without our written permission.
Subscriptions and billing
Some parts of the Service require a paid subscription. Fees are billed in advance on a recurring basis and are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period. We may change pricing with reasonable advance notice.
Your content
You retain all rights to the code, data, and content you submit to the Service. You grant us the limited rights needed to operate the Service on your behalf, such as reading repository contents you have authorized in order to run accessibility checks. Our handling of personal information is described in our Privacy Policy.
Intellectual property
The Service, including its software, design, and content (excluding your content), is owned by AccessLint, LLC and protected by applicable intellectual property laws. Open source components are licensed under their respective licenses.
Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. Accessibility testing is automated and does not guarantee conformance with any accessibility standard, law, or regulation, including WCAG, the ADA, or Section 508. You are responsible for verifying the accessibility and legal compliance of your own products.
Limitation of liability
To the maximum extent permitted by law, AccessLint, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the amounts you paid us in the twelve months preceding the claim.
Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service. Upon termination, provisions that by their nature should survive (including ownership, disclaimers, and limitations of liability) will survive.
Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on our site before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
